PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING INDIVIDUAL ARBITRATION PROVISION AND CLASS ACTION WAIVER (SECTION 17), A PERMANENT-RETENTION PROVISION GOVERNING YOUR CO-PARENTING COMMUNICATIONS AND ALL CONTENT YOU SHARE WITH YOUR CO-PARENT (SECTION 6), AND IMPORTANT LIMITATIONS ON OUR LIABILITY (SECTIONS 14-15).
1. Acceptance of These Terms; Electronic Agreement
These Terms of Service ("Terms") are a legally binding agreement between you and CoParent Pilot, LLC, a Michigan limited liability company ("CoParent Pilot," the "Company," "we," "us," or "our"), governing your access to and use of the CoParent Pilot web application, websites, and related services (collectively, the "Service").
By clicking "I Agree," creating an account, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. United States Only
The Service is offered solely within the United States of America. We are not subject to GDPR, UK GDPR, PIPEDA, or other non-U.S. privacy regimes.
3. Eligibility
The Service is available only to individuals who are at least 18 years of age. By creating an account you represent and warrant that you are at least 18 years old.
4. Description of the Service
CoParent Pilot provides a secure platform for co-parents to communicate, coordinate schedules, and maintain a documented record of their co-parenting communications. We are a technology provider, not a law firm.
5. Accounts and Security
You must provide accurate registration information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
6. The Permanent Record
The Permanent Record consists of all communications sent between connected co-parents and all Shared Content. The Permanent Record is retained until the youngest child identified in your family profile reaches 18 years of age. It cannot be edited, deleted, or altered by you, your co-parent, or CoParent Pilot personnel.
7. Private Content
Content you create that you have not shared with your co-parent remains under your complete control. You may edit, export, or permanently delete Private Content at any time.
8. Attorney Communications
Communications between you and an attorney you connect to your account are encrypted in transit and encrypted at rest using AES-256 encryption, and are kept separate from your parent-to-parent Permanent Record. Because we operate this encryption and hold the keys, we are technically able to access attorney-channel content and may be required to disclose it in response to valid legal process.
9. Acceptable Use
You agree not to use the Service to harass, threaten, stalk, or abuse any person; to upload unlawful content; to impersonate any person; or to interfere with the Service.
10. Your Content; License to Us
You retain ownership of content you submit. You grant CoParent Pilot a non-exclusive, royalty-free, worldwide license to host, store, reproduce, and transmit User Content solely to operate and improve the Service. We do not sell User Content or use the contents of your communications for advertising.
11. Plans, Fees, and Billing
CoParent Pilot offers a free tier and paid add-ons. Paid plans renew automatically until cancelled. Fees are non-refundable except where required by law.
12. No Legal Advice
CoParent Pilot is not a law firm and does not provide legal advice. Use of the Service does not create an attorney-client relationship with CoParent Pilot.
13. Intellectual Property
The Service is owned by CoParent Pilot or its licensors. DMCA notices: CoParent Pilot, LLC, 307 W 6th St., Suite 207, Royal Oak, MI 48067, info@coparentpilot.com.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, COPARENT PILOT DISCLAIMS ALL WARRANTIES.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
16. Governing Law
These Terms are governed by the laws of the State of Michigan. Jurisdiction: Oakland County Circuit Court, 6th Judicial Circuit.
17. Dispute Resolution - Binding Individual Arbitration
Any dispute will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules. The seat of arbitration is Oakland County, Michigan. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES INDIVIDUAL CAPACITY - NO CLASS ACTIONS.
18. Termination
You may close your account at any time. Sections 6, 8, 10, and 14-18 survive termination.
19. Changes to These Terms
We may modify these Terms prospectively with at least 30 days notice. CoParent Pilot, LLC, 307 W 6th St., Suite 207, Royal Oak, MI 48067, info@coparentpilot.com.
